Although not necessarily required by law, many employers offer their employees paid leave (or “PTO”), including vacation days, statutory holidays and personal leave. Under New Jersey`s Financial Security and Empowerment Act (“SAFE”), employees have the right to take up to 20 days of unpaid leave necessary because they or an immediate family member have experienced domestic violence or sexual assault. They must keep records documenting compliance with the law for five years, including hours worked by employees and sick leave accumulated or advanced, used, paid and transferred. The reasons for sick leave must be treated confidentially, unless the employee gives written authorization for disclosure. Records must be provided to NJDOL upon request.
